I take it this means the CA AG did not see the error of his ways and will see YTB in court?

ReplyDeleteI'll be willing to bet that it will never go to court. YTB will either stop selling in CA or go out of business. They cannot afford the attorney fees.
ReplyDeleteDoes filing bankruptcy get you a "get out of jail free card? That may be the way to go if it does...they will never be able to afford to pay the settlement, the loss and probably not the fees. And this is just ONE of the cases against them.

BK is not a get out of jail free card since it was not solely YTB named in the complaint. They are going after YTB, the Tomers, Cauthen, Sorensen and 100+ Directors personally.
ReplyDeleteSo, yes they can stop doing business in CA, but CA is their largest state and I imagine they will have more problems on their hands because they promised all these California Reps the lifetime residuals.
And if they do cease in California, you know that Illinois will be right behind them, and then many others as well.
If they file BK (and I do think that ultimately is what will happen), the plaintiffs (California and the two Class Actions at this point) need to determine if there are enough personal assets to go after these people individually and if they have a strong enough case to go after them.
I am not sure of the appeal process (if any) but I would guess that 2009 is not going to be a banner year for YTB and I doubt that they will see 2010.
From your calendar, it would appear that your insinuations are that you are the STAR Witness that is going to testify on how YTB ripped you off and STOLE your MONEY? Are you also going to spin the numbers on how many of your clients they took away from your business?
